DIGITOOLKIT

Terms of use

1. Who these terms are with

These terms govern your use of this website and of the apps published by Digitoolkit Ltd, a company registered in England and Wales (company number 17198401), registered office 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("we", "us", "our"). By downloading or using one of our apps, you accept these terms.

Apps distributed through the App Store are also subject to Apple's own licence terms for third-party applications, which apply alongside these terms. Where the two genuinely conflict, Apple's terms take precedence for matters concerning the App Store itself.

2. Licence

We grant you a personal, non-exclusive, non-transferable licence to use our apps on devices you own or control, for your own purposes. You may not copy, redistribute, sell, rent, reverse-engineer or attempt to extract the source code of our apps, except to the extent that applicable law expressly permits it despite this restriction.

3. Purchases

Some apps offer one-off in-app purchases that unlock additional features permanently. Purchases are processed by Apple as merchant of record; we never see or handle your payment details. Prices are shown in your local currency before you confirm.

Because unlocked features are delivered immediately, the statutory 14-day cancellation right for digital content does not survive delivery once you have agreed to it. Refunds are at Apple's discretion and are requested via reportaproblem.apple.com. If you have paid for a feature and it is not working, contact us and we will fix it or help you obtain a refund.

Purchases are tied to the Apple Account used to make them and can be restored on your other devices signed in to that account.

4. What our apps are, and are not

Our apps are conveniences, not safety systems. In particular, a timer app depends on your device having power, correct system time, and permission to deliver notifications; iOS Focus modes, Low Power Mode and silenced notifications can all delay or suppress an alert.

Do not rely on our apps for anything where a missed alert would be dangerous or costly, including food safety, medication, or any situation involving heat, machinery or unattended cooking. You remain responsible for what happens in your kitchen. Cooking times you enter are your own; we do not verify that any duration is sufficient to cook food safely.

5. Availability and changes

We aim to keep our apps working on currently supported versions of iOS, but we do not guarantee uninterrupted availability, compatibility with every device, or that any particular feature will remain in the app forever. We may add, change or remove features, and may discontinue an app. If we discontinue an app that you have paid for, features already unlocked will continue to work on the version installed on your device; we cannot guarantee it will keep working across future iOS releases.

6. Acceptable use

Do not use our apps or website unlawfully, attempt to compromise their security or availability, or use automated means to interfere with either. Do not misrepresent your relationship with us or use our name, the bit. name, or our logos in a way that suggests endorsement we have not given.

7. Intellectual property

All rights in our apps, this website, and their content, design and branding belong to us or our licensors. The Press Start 2P typeface used in our interfaces is licensed under the SIL Open Font License. Nothing in these terms transfers ownership of anything to you.

8. Liability

Our apps are provided as they are. To the fullest extent permitted by law, we exclude liability for indirect or consequential loss, loss of data, loss of profit, and spoiled food or ruined meals. Where liability cannot lawfully be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim, which for a free app is nil.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under UK law. If you are a consumer, your statutory rights are unaffected by these terms.

9. Privacy

How we handle personal data is set out in our privacy policy and in each app's own policy.

10. Changes to these terms

We may update these terms. The current version always lives at this address, with the date of the last change at the top. Continuing to use our apps after a change means you accept the revised terms.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your own jurisdiction.
